CONDITIONS OF
HIRE
- In these conditions, Hart & Co. Ltd. their
sub-contractors or agents are referred to as "the company".
These Conditions shall form part of the contract
and shall over-ride any other terms which are inconsistent therewith
unless a special contract is made in writing, therein it is expressly
stated that these conditions shall not be applicable or are treated as
varied.
Quotations shall be valid for a period of one
month from date of issue.
The Hirer shall pay the company the stated
deposit, plus Value Added Tax on acceptance of a Quotation. THIS
DEPOSIT IS NON RETURNABLE.
The Hirer shall, not less than
14 days before
the function date pay to the company a further 50% of the agreed price,
plus Value Added Tax, all terms being strictly nett. In the event that
the hirer fails to make such payment, the contract will be void and the
10% deposit be forfeit to the company.
The remaining
40% shall be due to be paid within
14 days of the hire, together with the cost of any extra items hired and
any additional charges of any kind that have been incurred.
FORCE MAJEURE . . . while every effort will be
made by the company to carry out any accepted contract, the full
performance of it is subject to variation or cancellation by the company
consequent upon Act of God, War, Riots, Strikes, Lock-outs or other
Labour disturbances, Fire, Flood, Restrictions on the use of Transport,
Fuel or Power, Requisitioning, shortage of material or transport or any
other cause beyond the control of the company. In the event of
completion being frustrated due to any of the above causes, deposit
would be returned in full if erection was not started, whereas in the
event of tentage being usable but not fully completed, a fair settlement
would be decided upon.
All complaints shall be made within seven days
of the hire date otherwise no claims can be entertained by the company.
Customers must satisfy themselves
BEFORE USE that all equipment ordered
has been delivered and the attention of the company drawn to any
miscounts, omissions, breakage's or wrong deliveries.
Damage, other than fair wear and tear will be
charged for.
Removal will be effected as soon as possible
after the event but all equipment cannot be collected immediately after
use from all sites. Safe custody of all equipment will be the hirer's
responsibility until collected, provided collection takes place within a
reasonable period.
Sites must be accessible by motor transport and
must either be marked out or the hirer must arrange to meet our staff on
arrival to arrange setting out, waiting time will be charged in addition
to our quoted price.
UNDERGROUND SERVICES . . . Pipes, cables etc,
MUST be marked and pointed out to our staff, otherwise no responsibility
can be taken for any damage caused.
Period of hire . . . is understood to mean the
period for which the equipment is required and ready and available for
use.
INSURANCE . . . for equipment on site once
handed over ready for use is the responsibility of the hirer. We can
arrange Insurance cover for private customers in their gardens for Fire,
Aircraft Damage and Explosion. We are happy to provide Insurance Values
on request.
Value Added Tax is not included in Estimates or
Quotations unless specifically stated.
Any agreed variation or any of the above
conditions shall not invalidate the remainder.
All orders undertaken are accepted subject to
these conditions of hire and by allowing or authorising work to proceed
the hirer is held to have acknowledge this fact.
Please note that tables and chairs are delivered
and stacked on site . . . not set out and arranged, this being the
caterers task as only he knows the required layout. We can set out if
required, but only if the arrangements are made when the equipment is
ordered. A charge will then be made.
Cancellations received within 28
days of date of hire, a charge of 25%
may be made if equipment reserved cannot be re-hired.
